These Terms of Use ("Terms") govern your access to and use of the FlexCalls website, application, and related services (collectively, the "Service") operated by FlexCalls ("FlexCalls," "we," "our," or "us").
By accessing, registering for, or using the Service in any manner, you agree to be bound by these Terms and all applicable laws. If you do not agree, you may not use the Service.
FlexCalls provides a technology platform that enables individuals and organizations ("Consultants") to offer and receive payment for time-based phone calls with other users ("Callers"). FlexCalls is not a party to any call, consultation, or transaction between Callers and Consultants and does not provide professional advice or services of any kind.
FlexCalls provides tools for scheduling, connecting, and billing calls, but does not supervise, manage, or guarantee interactions between users.
Consultants are independent individuals or entities and are not employees, agents, representatives, or partners of FlexCalls.
FlexCalls does not monitor, record, participate in, or control the content of calls and has no responsibility for statements made by users during calls. FlexCalls is not responsible for user-generated content, statements, or conduct and acts solely as a passive conduit for communications between users.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements and that all information you provide is truthful and accurate.
To access certain features, you may be required to create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
FlexCalls reserves the right to suspend or terminate accounts that are incomplete, inaccurate, or in violation of these Terms.
Payments are processed through third-party payment processors, including Stripe.
By using the Service, you agree to comply with Stripe's terms of service and to provide accurate payment and identification information as required by law.
Consultants authorize FlexCalls and its payment processor to receive payments from Callers, deduct applicable platform and processing fees, and remit the remaining funds to the Consultant's connected account.
All calls must have a minimum charge of $0.50 for payment to process.
All fees, commissions, and rates are disclosed prior to any transaction.
FlexCalls may adjust its fee structure at any time with notice.
FlexCalls may, at its discretion, investigate, respond to, and resolve payment disputes, chargebacks, reversals, or refunds. Decisions regarding disputes or payment reversals are final and binding. FlexCalls is not obligated to intervene in disputes between Callers and Consultants except as required by applicable law or payment processor rules.
FlexCalls merely facilitates communication and payment between independent users.
FlexCalls does not guarantee results, accuracy, or satisfaction from any interaction.
Each call transaction is billed automatically based on actual call duration.
Refunds are not guaranteed and may only be issued at FlexCalls' discretion in cases of verified technical failure, fraud, or other exceptional circumstances.
Consultants and Callers may cancel a scheduled call through the platform prior to its start time. Late cancellations or missed calls may be subject to applicable fees as disclosed on the Service.

The Service may not be used to provide, promote, facilitate, or engage in content, services, or activities that FlexCalls determines, in its sole discretion, to be inappropriate, objectionable, or inconsistent with the intended purpose or values of the platform. This includes, without limitation:
FlexCalls reserves the right to investigate any suspected violation of this section and to suspend or terminate accounts, restrict access to the Service, or take other appropriate action at its sole discretion.
Users are solely responsible for complying with all applicable laws regarding call recording, monitoring, or interception, including obtaining any required consent from all participants. FlexCalls does not obtain consent on behalf of users and shall not be liable for any recording or monitoring conducted by users in violation of applicable law.
All software, design, logos, and content on the Service are owned or licensed by FlexCalls and protected by copyright and trademark laws.
You retain ownership of any content you provide (such as your bio, description, or profile photo) but grant FlexCalls a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for operating and promoting the Service.
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described therein.
FlexCalls provides the Service "as is" and "as available" without any warranty of any kind.
FlexCalls does not guarantee uninterrupted service, accuracy, or reliability.
Consultants are not employees or agents of FlexCalls, and FlexCalls does not endorse or verify any statements or advice provided by them.
You acknowledge that your use of the Service is at your sole risk.
FlexCalls does not guarantee the availability, quality, continuity, or completion of any phone call. Call performance may be affected by factors outside FlexCalls' control, including telecommunications carriers, network congestion, hardware, software, or third-party service outages. FlexCalls shall not be liable for dropped calls, poor audio quality, delays, or failed connections.
To the fullest extent permitted by law, FlexCalls shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or reputational harm, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
FlexCalls' total liability arising out of or relating to any call shall not exceed the amount paid for that call.
For all other claims, FlexCalls' total liability shall not exceed the total amount paid to FlexCalls by the user in the three (3) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless FlexCalls, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from:
(a) your use of the Service;
(b) any advice, statements, or materials you provide;
(c) your violation of these Terms; or
(d) your violation of any law or rights of a third party.
FlexCalls may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms or suspected fraud.
You may close your account at any time by contacting support or using account settings.
Provisions relating to payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law shall survive termination or expiration of these Terms.
FlexCalls shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, power failures, internet or telecommunications outages, or failures of third-party service providers. Performance shall be excused for the duration of such event.
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Kalamazoo County, Michigan, and you consent to the personal jurisdiction of such courts.
FlexCalls may update these Terms at any time by posting a revised version on the website. Continued use of the Service after the effective date of such changes constitutes acceptance of the new Terms.
